1. Parties and Agreement
These Terms of Service ("Terms") govern the relationship between Hong Kong Huayou Health Consulting Limited (香港華佑健康諮詢有限公司), a company incorporated in Hong Kong (Company Registration No. 80227624) with its registered address at Kwai Shing Industrial Building Phase 1, 36–40 Tai Lin Pai Road, Kwai Chung, New Territories, Hong Kong, and trading as China Care Health Tours ("China Care", "we", "us", "our"), and any individual or organisation ("Client", "you") who engages our services.
Acceptance. These Terms become binding on you when you sign a Service Agreement with us, or (where no Service Agreement has been signed) when you take a positive step to engage our services, such as explicitly requesting that we commence work on your case in writing. Merely contacting us with an enquiry, browsing this website, or submitting medical records for an initial free assessment does not by itself constitute acceptance of these Terms. The specific scope of services, fees, and any additional terms for your engagement will be set out in a separate written Service Agreement ("Service Agreement"), which takes precedence over these Terms in the event of any conflict.
If you are acting on behalf of another person (for example, as a family member or carer), you confirm that you have authority to bind that person to these Terms and the Service Agreement.
Travel Agent Licensing Notice. China Care Health Tours provides medical travel facilitation and coordination services. To the extent that any element of our services could be characterised as the sale or arrangement of travel or accommodation for reward, you acknowledge that our primary role is as a medical coordination intermediary and not as a licensed travel agent or tour operator. We do not hold a travel agent licence under the Travel Agents Ordinance (Cap. 218) and do not sell packaged travel. Clients should arrange flights, travel insurance, and accommodation independently or through a licensed travel agent. We can refer you to suitable providers but we are not responsible for those bookings.
2. Nature of Service
China Care Health Tours provides medical travel facilitation and coordination services. Our services may include, but are not limited to:
- Case assessment and hospital matching based on the information you provide
- Liaison with partner hospitals and physician teams in China on your behalf
- Translation and submission of medical records to hospitals
- Support with Chinese medical visa applications
- Travel logistics coordination including accommodation recommendations and airport transfer arrangements
- On-the-ground coordination and interpretation support during your hospital stay
- Post-treatment follow-up communication between you and the hospital
The specific scope of services for your case will be confirmed in a separate written service agreement before any fee is charged.
3. Not Medical Advice
China Care Health Tours is not a licensed medical provider and does not provide medical advice, medical diagnosis, or medical treatment.
Nothing we communicate — verbally, in writing, on our website, or through any other channel — constitutes medical advice. All clinical decisions, including diagnosis, treatment selection, and management, are made solely by licensed physicians and clinical teams at the partner hospitals you engage.
You are solely responsible for your own healthcare decisions. We strongly recommend that you consult your own physician before making any decisions based on information provided by China Care.
4. Client Eligibility
You must be at least 18 years of age to engage our services directly. If you are enquiring on behalf of a minor or an adult who lacks capacity to consent, you must have legal authority to act on their behalf and confirm this to us in writing.
We reserve the right to decline to provide services to any individual at our discretion, including where we assess that the case is not suitable for medical treatment in China or where we are unable to ensure adequate coordination for your specific situation.
5. Fees and Payment
Our coordination fee is fixed and agreed in writing before any work begins. Your treatment cost is quoted directly by the hospital and shown as a separate line item in every cost estimate we provide. We never add to, inflate, or mark up the hospital's quoted treatment cost.
Our fee covers coordination services only. It does not cover:
- Hospital treatment costs, which are invoiced directly by the hospital
- Flights, accommodation, or travel insurance
- Visa application government fees
- Any costs incurred as a result of changes to your treatment plan by the hospital
Payment terms, accepted methods, and currency will be specified in your service agreement. All fees are quoted and payable in the currency specified in that agreement.
6. Cancellation and Refunds
Cancellation and refund terms depend on the stage at which you cancel and will be detailed in your service agreement. The following general principles apply:
- Before service begins: If you cancel before we have commenced work on your case, any fees paid will be refunded in full, less any bank transfer charges.
- After work has commenced: If you cancel after we have begun case coordination (including any hospital liaison, medical record translation, or visa support), a pro-rated fee reflecting work completed may be retained.
- Hospital cancellations: If a hospital cancels or reschedules your treatment, China Care will assist you in finding an alternative. We are not liable for costs arising from hospital-initiated cancellations.

7. Hospital and Physician Relations
China Care Health Tours facilitates access to independent hospitals and physicians in China. These institutions and practitioners are independent third parties and are not employees, agents, or contractors of China Care.
We do not control, supervise, or warrant the quality, safety, or outcomes of medical treatment provided by any hospital or physician. All contractual relationships for medical treatment are directly between you and the hospital concerned.
Our assessment of hospitals is based on publicly available information, site visits where undertaken, and information provided to us by the hospitals. We do not guarantee the accuracy of hospital-provided information and recommend that you conduct your own due diligence before proceeding with treatment.
8. Limitation of Liability
To the fullest extent permitted by applicable law, including the Control of Exemption Clauses Ordinance (Cap. 71):
- Medical outcomes: China Care Health Tours shall not be liable for any medical outcomes, complications, adverse events, or treatment decisions arising from care provided by any hospital or physician. Our role is limited to coordination; clinical responsibility rests entirely with the treating institution.
- Monetary cap: Our total aggregate liability to you for all claims arising out of or in connection with our services (whether in contract, tort, or otherwise) shall not exceed the total coordination fees actually paid by you to China Care under the relevant Service Agreement. We consider this cap reasonable given that our role is limited to facilitation and the primary financial relationship for treatment is between you and the hospital directly.
- Excluded losses: We shall not be liable for loss of income, loss of profit, loss of opportunity, loss of data, or any indirect or consequential loss, provided that this exclusion does not apply where such loss arises directly from our fraud or wilful misconduct. Reasonable and foreseeable travel costs wasted as a direct result of our own breach of the Service Agreement are not excluded by this clause.
Non-excludable liability. Nothing in these Terms excludes or limits our liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by our negligence; or (c) any other liability that cannot lawfully be excluded or restricted under Hong Kong law, including under Cap. 71.
Reasonableness. We draw your attention to the limitations above and invite you to seek independent legal advice if you have concerns. By signing a Service Agreement, you acknowledge that these limitations are reasonable in the context of the services provided.
9. Confidentiality
We understand that the information you share with us, including your medical history, diagnosis, and treatment records, is highly sensitive. We treat all client information as confidential and will not disclose it to any third party except:
- To hospitals and physicians as necessary to facilitate your case, and only with your consent
- To translators or logistics providers engaged by us to deliver our services, who are bound by confidentiality obligations
- Where required by law or by a court order
We do not sell, rent, or otherwise commercialise client information.
10. Data and Privacy
The collection, use, and storage of your personal data is governed by our Privacy Policy, which forms part of these Terms. By engaging our services, you acknowledge that you have read and understood our Privacy Policy.
We collect personal data only as necessary to provide our services and comply with applicable law. Medical records and health information are stored securely and access is restricted to personnel directly involved in your case.
11. Intellectual Property
All content on the China Care Health Tours website, including text, images, graphics, and design, is owned by or licensed to Hong Kong Huayou Health Consulting Limited. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.
You retain ownership of any medical records and personal documents you provide to us. By submitting documents to us, you grant us a limited licence to use them solely for the purpose of providing our services to you.
12. Governing Law and Disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Hong Kong courts.
Before initiating formal proceedings, we encourage you to contact us directly at info@chinacarehealthtours.com to attempt to resolve the matter informally. Most concerns can be addressed promptly through direct communication.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be published on this page with a revised "Last updated" date. For material changes, we will notify active clients by email where we hold a current email address.
Prospective effect only. Any variation to these Terms takes effect only in relation to new Service Agreements entered into after the date of the variation. Where you have already signed a Service Agreement, the Terms in force at the date of that Agreement continue to govern that engagement unless you and we expressly agree in writing to apply the revised Terms.
14. General
Entire Agreement. These Terms, together with the Service Agreement and the Privacy Policy, constitute the entire agreement between you and China Care in relation to the services and supersede all prior representations, discussions, and agreements. Each party acknowledges that it has not relied on any representation that is not expressly set out in these documents.
Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force and effect.
Waiver. No failure or delay by either party in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver is only effective if made in writing and signed by the waiving party.
Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in the event of a merger, acquisition, or sale of substantially all our assets, provided that the successor entity assumes all our obligations under the relevant Service Agreement.
Notices. Any formal notice required under these Terms must be given in writing and delivered by email to the address specified in the relevant Service Agreement (or, if none is specified, to info@chinacarehealthtours.com for notices to China Care, and to the email address you provided at engagement for notices to you). Notices sent by email are deemed received on the next business day in Hong Kong after transmission, provided no delivery failure notification is received.
Force Majeure. Neither party shall be in breach of these Terms or liable for any delay or failure to perform any obligation to the extent that such delay or failure results from circumstances beyond that party's reasonable control, including acts of God, pandemic, war, civil unrest, governmental action, natural disaster, or failure of third-party systems. The affected party must notify the other promptly and use reasonable endeavours to mitigate the effect of the force majeure event. If the event continues for more than 60 days, either party may terminate the Service Agreement by written notice, and a pro-rated refund of prepaid coordination fees for work not yet commenced will be provided.
Third Party Rights. These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) or otherwise. Only the parties to the Service Agreement may enforce these Terms.
Data Protection. Processing of personal data in connection with our services is governed by our Privacy Policy. By entering into a Service Agreement, you confirm that you have read the Privacy Policy and consent to the collection, use, and international transfer of your personal data as described therein, including transfer to recipients in mainland China for the purpose of your case coordination.
